Terms and Conditions of Sale

  1. This Bidder Agreement is made between The Miami Auction Center and/or its assigns (“Auction Company”), and the person or entity listed on the Bidder Agreement.
  2. The Auction Company is performing an auction service, and is responsible solely for their warranties and guarantees set forth herein.
  3. All vehicles or any other purchases (“Items”) are sold “AS IS/WHERE IS”, present condition, and without any guarantees by Auction Company. In no event should the Auction Company be responsible for any guarantees. Any guarantees written or implied as to the authenticity, originality, or condition of any Item are not the guarantee of the Auction Company, and should be determined by the buyer’s own inspection. The Item and information presented at the time of the auction supersedes any previous representations.
  4. A buyer’s premium of 8% of the final bid price is payable for all Items and (15% for Memorabilia lots), plus all applicable taxes and license fees. Acceptable forms of payment include wire transfer, certified check or cash US currency. All bidder fees are non-refundable and non-transferrable. Bidder/Buyer agrees to pay for all Items on the day of the sale. An Item will not be released until the buyer’s funds have cleared Auction Company’s bank account. The Title or Bill of Sale shall be delivered to the buyer within twenty-one (21) business days of auction end.
  5. All transactions are to abide by the laws and rules of uniform code in the state of Florida. All matters pertaining to the Bidder Agreement (including its interpretation, application, validity, performance and breach) shall be governed by, construed and enforced in accordance with the laws of the State of Florida. 
  6. All the Terms and Conditions of Sale are posted on the auction premises, printed in sales brochures, forms, signs, or otherwise published and are incorporated herein by reference.
  7. Should the buyer default upon any purchase for any reason, buyer agrees to pay Auction Company the full sum of both the buyer’s premium and seller’s commission. Buyer also agrees to pay any court costs, attorney fees, and any other related costs and expenses as a result of buyer’s default.
  8. All Items are sold by Lot Number. The auctioneer has the right to place a bid for consignor/owner/seller in an amount not to exceed the reserve. Under no circumstances, will the auctioneer place a bid for the consignor/owner/seller at the reserve or above the reserve.
  9. Auction Company shall not responsible for any lost, stolen, or damaged Items. All Items must be removed within forty-eight (48) hours of the auction ending. If an Item is not removed from the premises, the Auction Company may remove the Item and all costs associated with removing, storing, etc. shall be paid solely by the buyer.
  10. Should any dispute in a bid arise, the auctioneer shall use his/her judgment and the decision made by the auctioneer shall be final.
  11. If an Item does not sell, Auction Company will attempt to secure a buyer by the same terms according to this agreement.
  12. A buyer’s failure to comply with all of the Terms and Conditions of Sale entitles Auction Company to use any and all available remedies or courses of legal action to hold the buyer liable. This may include any of the following:
    1. Cancel the sale and retain as liquidated damages all payments made by the buyer.
    2. Re-sell the Item to a new buyer at a private or public sale and in any such event the buyer shall be liable for any deficiency plus any incurred attorney fees and/or court costs.
  13. By signing the Bidders Agreement, the bidder has read and understood the Terms and Conditions of Sale.
